Book chronicles mining plunder and struggle in Mindanao

The latest book on large-scale mining plunder in Mindanao, “Undermining Patrimony”, is launched with the Lumad participants of Manilakbayan 2015.

Sr. Francis Añover, national coordinator of the Rural Missionaries of the Philippines (RMP), and Sr. Stella Matutina of Panalipdan introduced the book. Reviews by Prof. Rogelio Ordoñez and Prof. Roland Simbulan.

Aquino, AFP afraid of skeletons in the closet

​“Scared to reveal the skeletons in the closet, Colonel Benjamin Hao?” Cristina Palabay, Karapatan secretary general said in response to Army Spokesperson Col. Hao’s threat to deport the foreigners who joined the International Fact Finding Mission (IFFM) held in Surigao del Sur, where the September 1 massacre and other military and paramilitary atrocities were committed.

Held on October 26 to October 30, the IFFM teams went to different villages in Lianga and San Miguel, Surigao del Sur  to investigate the extent of human rights violations perpetrated by both the Magahat-Bagani paramilitary group and the 75th and 36th Infantry Battalion of the Philippine Army. Initial results of the mission indicated that rights violations were committed even after Lumad evacuated as a result of the massacre of school executive Emerito Samarca and Lumad leaders Dionel Campos and Juvello Sinzo.

In at least two communities, houses and farm equipment were burned down. The majority of the houses were ransacked and defaced, including the schools. The pigs and chickens raised by individual households, as well as those in Alcadev demo farms, were stolen. Farm tools, personal belongings and household utensils were stolen.

“By showing its claws to the international observers, the Philippine Army is preempting the full disclosure of the abuses and violations they committed against the Lumad. The AFP is again trying to divert the issue,” Palabay said.

Palabay reminded the BS Aquino regime that harassing foreigners who take part in activities promoting human rights violates the people’s right to international solidarity. Under the Aquino administration, Karapatan earlier documented cases of Dutch youth Thomas Van Beersum and Canadian Kim Chatillon Meunier who were both detained and deported—even as they were already on their way back to their respective countries—for participating in international events and fact-finding missions.

“The right to international solidarity shall be understood as a fundamental human right by which peoples and individuals have the freedom to enjoy, on the basis of equality and non-discrimination, the benefits of a harmonious international society with a just and fair international political and economic order, in which all human rights and fundamental freedoms may be fully realized,” Palabay quoted the draft United Nations declaration on the right of peoples and individuals to international solidarity.

“It looks like the BS Aquino regime has more secrets to keep on the human rights situation in the country. Malacañang and the Department of Foreign Affairs have repeatedly turned down the requests of UN experts to investigate on the numerous reports of political killings, forcible evacuation, illegal arrests and other human rights violations. On the other hand, Aquino has welcomed US and other foreign troops that commit human rights abuses within our territory,” Palabay concluded.

Conflicting lies of AFP, Palace, CHR protect state perpetrators, Aquino — Karapatan

“The whitewash, cover up and lies of the Armed Forces of the Philippines, Malacañang and the Commission of Human Rights (CHR) on the recruitment of Lumad in the military and Civilian Armed Force Geographical Unit (CAFGU), nevermind if they are conflicting, are directed to one thing—to shield the BS Aquino government from accountability on the Lumad killings,” Karapatan Secretary General Cristina Palabay said.

Palabay explained, “the CHR deliberately turned a blind eye on the real issue of the Lumad—that they are targets of the Philippine government’s counterinsurgency program Oplan Bayanihan, which resulted in the extrajucidial killings, forced evacuations, and attacks on schools, among others.”

“The CHR’s assertion that the perpetrators of rights violations are both the state and non-state actors washes off the regime’s accountability for the widespread violations among the Lumad. Remember, it is the Philippine Army troops and its paramilitary which caused thousands of Lumad to evacuate their homes because of the killings, bombardment of communities and forced recruitment into the paramilitary groups,” she added.

“Malacañang, through its spokesperson Edwin Lacierda, also dished out another lie by saying the AFP is not recruiting Lumad. “The Palace was actually being careful not to implicate the Commander-in-Chief in the series of human rights violations against the Lumad through Oplan Bayanihan, a program steered and implemented by the Cabinet Cluster on Security, Justice and Peace and the AFP,” Palabay said.

“The AFP, feigning innocence for the nth time while contradicting the Palace, admitted otherwise. Using the ‘equal opportunity’ card, the AFP admitted recruiting Lumad, but was quick to deny any involvement in the killings. What the AFP didn’t admit is the forcible recruitment of Lumad into the AFP-backed paramilitary groups and in the Barangay Defense System, appropriating unto itself the ‘traditional Lumad defense system’ and bastardizing the very concept of it,” she stated.

At the plenary deliberations on the proposed national budget at the House of Representatives on October, the Department of National Defense admitted that more than half of the CAFGU or about 30,735 are in Mindanao. Karapatan said many of these CAFGU are recruited, forcibly or with promises of privileges, by the AFP.

Karapatan cited the cases of forced recruitment in Talaingod, Davao del Norte. On March 8, five members of Alamara and 30 soldiers of 68th Infantry Battalion interrogated and accused 30 year old Datu Sumpo Taosan of being a commander of the NPA. They told him to surrender and to join the Alamara paramilitary group or his tribe will be hunted down. On the same day, more than 20 armed men from the 68th IBPA arrived in Sitio Nasilaban, Brgy. Palma Gil, Talaingod and summoned Awing Apoga for questioning. A certain ‘Cabagnan’ told him to join the Alamara and to persuade his father Datu Guibang to surrender. Datu Gibang is a staunch defender of the tribe’s ancestral lands. Awing politely declined. After the incident, Awing joined the hundreds of Talaingod residents who evacuated to Davao City.

Also in Brgy. White Culaman, Kitaotao, Bukidnon, Brgy. Captain Felipe Cabugnason, acting on orders of the military, summoned all male residents in his community on September 7. The male residents were forcibly recruited into the Barangay Defense System and were compelled to serve as night guards for the 8th and 23rd IB encamped at the barangay hall supposedly to repel ‘NPA attacks’. Despite the residents’ opposition—saying they do not want to become pawns against the NPA—the military insisted.The military argued that those who will miss their duty as guards will be considered NPA members and will face arrest. The residents were also instructed to collect among those on duty Php 5 for coffee.

“We don’t have to ask which of these government agency is the better liar. It is obvious, all the deception, excuses and lies are to protect the State security forces responsible for the rights violations and Aquino as the Commander-in-Chief,” Palabay said.

Karapatan reiterated its support for the Lumad’s call to pull out army troops from indigenous people’s communities and disband paramilitary groups.

Justice Department commits, promotes rights abuses via Oplan Bayanihan — human rights groups

“Just like the Commission on Human Rights (CHR), the Armed Forces of the Philippines (AFP) and the rest of the BS Aquino agencies, the Department of Justice (DOJ) has been a party to the commission of human rights by implementing Oplan Bayanihan, particularly in filing false charges against activists and in deodorizing the crimes of the regime,” Karapatan secretary general Cristina Palabay said today as the Manilakbayan 2015 contingent from Mindanao staged a protest action in front of the Justice department.

A few weeks after being appointed as Justice Secretary, Alfredo Caguioa’s office was stormed by more than 500 Lumad and Mindanawon with human rights group Karapatan and members of progressive people’s organizations. The protesters slammed the DOJ’s role in the continuing systematic violations
of human rights among peasant and Lumad communities.

“The pattern of non-prosecution of murderers and torturers in the military and paramilitary groups, and the filing of trumped up charges against known leaders of Lumad and of progressive organizations are the key roles of the DOJ in Oplan Bayanihan. It has used the legal system to promote the climate of impunity in the Philippines and to violate the rights of human rights defenders and political activists,” Palabay said.

Karapatan noted that among the cases filed and pending at the DOJ are the murder of Italian priest Fr. Fausto Tentorio, the massacre of the Capion family, and the September 1 massacre of school executive Emerito Samarca, Lumad leaders Datu Juvello Sinzo and Dionel Campos. “None of those who pulled the trigger and the mastermind among the State security forces were actually arrested or even faced trial. The DOJ’s deliberate inaction on these cases has furthered the climate of impunity, encouraging further rights violations in Mindanao and all-over the country,” Palabay continued.

“During meetings and hearings the DOJ would often cite the many difficulties encountered with the PNP and AFP on the arrest of perpetrators among the military and paramilitary groups. Isn’t that the raison d’etre of the DOJ-led inter-agency task force? What’s the use of the PNP and the AFP sitting in the task force for “effective coordination”? This task force has accomplished nothing as far as conviction of State perpetrators of rights violations. It has only succeeded in exonerating high officials responsible for killings and other rights abuses and in wasting public funds,” she added.

Palabay explained, “DOJ is part of the regime’s Cabinet Cluster on Security, Justice and Peace with the AFP and the PNP. It has taken on the role of protecting State forces rather than dispensing justice to the victims of the State.” In few instances that it was compelled by strong public opinion to accede to the victims’ cries for justice, high officials of the military were freed from accountability and the cases filed against ordinary soldiers are almost always lower in degree than the actual crimes committed.

“Even the dirty scheme of filing trumped up cases against tribal leaders and human rights advocates is part of Oplan Bayanihan’s program to harass, illegally arrest, and imprison members and leaders of progressive people’s organizations. The DOJ essentially has taken over Gloria Arroyo’s Inter-Agency Legal Advisory Group (IALAG),” Palabay said.

In June, 22 churchpeople, human rights workers and victims of rights violations were falsely charged with criminal offense by the Philippine National Police in Socsksargen (South Cotabato-Sultan Kudarat-Sarangani and Gen. Santos City). These 22 individuals are leaders of groups which assisted the evacuees and those who participated in a fact-finding mission in Sitio Akbual, Brgy. Upper Suyan, Malapatan, Sarangani province. The mission was held to investigate the human rights abuses committed by the 73rd Infantry Battalion-Philippine Army (IBPA) against the Blaan tribe.

In Davao City, 15 Lumad leaders and human rights advocates were also falsely charged with kidnapping, illegal detention and human trafficking for ‘holding’ the Lumad evacuees at the United Church of Christ of the Philippines-Haran while 55 other leaders from the National Capital Region and Southern Mindanao were also implicated via a rogue gallery of the AFP. The charges were eventually dismissed for lack of evidence.

“The DOJ is responsible for the fabricated criminal charges against the 555 political prisoners, hounded by tortuous legal proceedings, barefaced maneuvers of the military, and repressive and inhuman conditions in jail. With the new Justice Secretary, who was Aquino’s classmate and Chief Presidential Legal Adviser, such violations are expected to continue,” Palabay said.

“The DOJ could only dispense an iota of justice to the victims of human rights violations if it acknowledges it is part of the State’s policy to arrest, detain, and kill people as it implements Oplan Bayanihan. There is no middle ground to justice. There are only the perpetrators and the victims. And in our case, the poor majority of the Filipino people are often the victims of state-perpetrated violence,” said Palabay.
